CONDITIONS OF THE SERVICE
GalindoBeach, allows short term renters (hereinafter the owner or the client), to outsource the obligations derived from the rental, facilitating the performance of a series of activities, such as the management of reservations, check-in/check-out follow-up, communication with guests, cleaning and laundry follow-up, among others, thus increasing the convenience of the rental, to owners and guests alike. These Terms and Conditions govern your access to and use of the website (hereinafter referred to as the Website), the services offered and the contracting of the same by customers, as well as all collective content, and constitute a binding contract between you and GalindoBeach. Please read these Terms and Conditions carefully each time you access the Website. We also recommend that you carefully read our Privacy Policy, as well as the Legal Notice, available on this website. If you do not agree with any of our policies, you will not be entitled to obtain any information or to continue using the Website or the Services. You acknowledge and agree that, GalindoBeach is not a PARTY to any agreement entered into between short-term landlords and guests, nor is GalindoBeach a real estate agency, agent or insurer. GalindoBeach has no control over the conduct of landlords, guests and/or other users of the website, the services offered by third parties or the condition of the accommodation, and disclaims all liability in this regard, to the fullest extent permitted by law.

ACCOUNT REGISTRATION
To access certain features of the Website, and to book the Services, you must register to create a GalindoBeach account. You can register to receive the Services directly through the Website. Your GalindoBeach account will be created for your use of the Site based on the personal information you provide. The information provided by you at the time of registration is important and must be true, complete and correct. You agree and undertake to update such information to keep it accurate, current and complete. By registering on our Website you agree to be bound by these Terms and Conditions and you agree that you have read and agree to the Terms and Conditions on our website. Upon registration you will be provided with a strictly personal username and password which you agree to keep confidential. You are responsible for safeguarding your password. You will immediately notify GalindoBeach of any unauthorised use of your GalindoBeach account. You may not assign or otherwise transfer your GalindoBeach account to another party. You are responsible for any and all activities that occur under your GalindoBeach account. By registering on our website you declare that you are of legal age, with full capacity to act and that you are able to contract the services offered by GalindoBeach. Cancellation of your registration on the GalindoBeach website for any reason will automatically terminate this Agreement.

OBJECT OF THE CONTRACT
The object of the contract is established as the provision of management services, in relation to the short-term rental of properties, by GalindoBeach in favour of the owner, who would become our main client. The owner can cancel this contract unilaterally at any time he/she wishes, with no commitment of permanence or financial penalty for the termination of the contract. The owner must communicate the termination of the contract by email to: info@galindobeach.com


TARIFF, PAYMENTS AND PAYMENT METHOD
GalindoBeach's tariff will be 165 € per month, VAT not included, and the client will make the monthly payments corresponding to the service provided according to the tariff indicated in the contract. The corresponding amounts will be invoiced between the 1st and 5th of each month of the provision of the services. The Client expressly accepts the sending of invoices in digital format. The invoices will be sent to the e-mail address indicated in this contract and can also be consulted and downloaded through the owner's area in the official website of GalindoBeach. The Client's payment will be made by Direct Debit by signing the corresponding document (SEPA) attached to this contract, the Client expressly accepts the issuance of bills to the bank account provided. The Client, therefore, is responsible for the availability of funds in his account during this period and for the remission of the necessary documentation to his bank for the collection of the invoices issued by GalindoBeach. In case of return of invoices, the Client is responsible for the payment of the Outstanding Invoice Processing Charges. The registered client will be able to review and modify through his proprietary space within the website, certain information related to his accommodation, such as a calendar of the selected and available dates or information of visitors and income among others.

SERVICES
The services defined below will be included in the management contract for short term or holiday property renters.

Tourist Licence.-  GalindoBeach will manage the registration of your holiday accommodation in the tourist registry of Andalucia or any other Autonomous Community free of charge, so that the property can be advertised on the different internet portals.

Photographic Report.-  GalindoBeach will make a free photographic report of the holiday accommodation to project a real image of the accommodation and to promote bookings.

Check-In Check-Out. -  Communication of the reservations to the person or company assigned by the owner and in charge of the check in/out, so that everything is ready for the guest's arrival. We also take care of drawing up and sending the holiday contract for the guest to sign. The owner authorises GalindoBeach to carry out the registration of the National Police, Guardia Civil or other Security Forces and Corps with competence in the matter and will also be in charge of communicating the data of the guests to the Security Forces and Corps with competence in the matter.

Cleaning.-  Communication of bookings to the person or company assigned by the owner and in charge of cleaning so that everything is ready for the guest's arrival.

Guest Communications.-  GalindoBeach will conduct communications with potential guests to provide information about the property and resolve issues that may arise during the booking process. GalindoBeach will also communicate with guests before, during and after their stay to help guests enjoy a smooth stay. The communication service with guests will be carried out from 8:00 to 00:00 hours 365 days a year. Included in the communications service is contact with guests to arrange check-in and check-out and recommendations on activities to do at the accommodation. GalindoBeach will assist the client with the selection and screening of guests for accommodation. The owner acknowledges and agrees that he/she is solely responsible for the selection of guests according to the acceptance criteria indicated by him/her. The rental agreement for the property shall bind only the Owner and the guest. The Owner acknowledges and agrees that GalindoBeach is not a real estate agent and will not negotiate or execute agreements with guests on their behalf. GalindoBeach will not be a party to any agreements between owners and guests. At the end of the stay GalindoBeach will be able to make a guest report on the booking portals. At the same time the satisfaction of the guests will be verified and their opinion will be recorded for the optimisation of the services offered. GalindoBeach will be able to mediate a possible disagreement between the owner and the guest through the resolution centre of the rental platform where the property is advertised. GalindoBeach reserves the right to participate in the resolution of a problem between the owner and the guest, and assumes no responsibility for the actions taken in the problem resolution process. For the correct management and communication with the guest, it is mandatory that the property has a wireless internet connection (WIFI).

Price management and calendar.-  GalindoBeach may update the price and adjust the calendar taking into account the different factors (including, but not limited to, the time of year, the competition or the type of building of the property) that may influence the rental of the property.

Optimisation of the profile.-  GalindoBeach may assist the owner with the optimisation of their accommodation profile on any of the third party platforms. The owner is solely responsible for the accuracy of all the information shown in the advertisement. With respect to third party platforms, GalindoBeach will take into account the owner's preferences as long as the owner has previously communicated them to GalindoBeach; in the absence of such preferences GalindoBeach expressly reserves the right to publish such rental(s) on the platform(s) it deems appropriate. The owner authorises GalindoBeach to include the holiday accommodation on all websites, including Airbnb, Expedia, Booking.com, HomeAway, etc., which are necessary to increase the number of bookings. Agency commissions will be 15% of the total amount of the booking. However, when the booking comes from our website, the commission for the owner will be 0 %.

Booking management.-  GalindoBeach will manage the bookings, updating the calendar on the different pages through our channel manager and answering all the doubts that the guests may have before deciding on which accommodation to rent.

Owner's Panel.-  GalindoBeach will provide the owner with a username and password, so that he/she can access the extranet and see at all times the situation of his/her property with regard to bookings, occupancy, prices, etc. Reservations are automatic and the owner receives them immediately by email.

Payment of bookings - GalindoBeach will not charge absolutely nothing from the guest's booking, including cleaning or other additional charges. The owner will receive the money directly from the guest or the agencies by bank transfer, either as a one-off payment, advance payment for the booking confirmation or final outstanding payment. The amounts will be paid into the bank account designated by the Owner for holiday rentals. GalindoBeach will at all times check with the Owner the update of the balances collected and pending payment for their correct accounting.

Management of maintenance, repairs and replacements.-  GalindoBeach will communicate to the person or company assigned by the owner and in charge of the maintenance tasks the possible repairs that may be necessary to offer the services and guarantee the guest's stay.

CANCELLATIONS AND CHANGES
The Owner is solely responsible for notifying GalindoBeach of any cancellation and/or modification that may take place, assuming any penalties that may arise from the same, exempting GalindoBeach from any responsibility.
In case of cancellation by the guest, this will be governed by the general contracting conditions and the corresponding penalties established for each period of time will be applied.

OBLIGATIONS AND RESPONSIBILITIES OF THE OWNER
In addition to other guarantees set out in these Terms and Conditions, the Owner guarantees compliance with the following clauses:The Client is a legal owner, lessor or authorised sub-lessor and has full authority to engage the services of GalindoBeach in relation to the terms of this Agreement.Owner acknowledges and agrees that GalindoBeach may provide the proposed services, through one or more third party providers. This Agreement is subject to the limitations of liability set forth herein.The Owner acknowledges and agrees to be responsible for all its property rental listings. GalindoBeach assumes no liability for any breach of contract between a third party and the Owner.The Owner warrants that the information provided in his/her advertisements on rental platforms will be true and accurate in all respects. In no event shall GalindoBeach have any liability whatsoever for any inaccuracy, error or omission in the rental listing of the property.The Owner acknowledges that he/she is solely responsible for the maintenance of the accommodation, and does not hold GalindoBeach responsible for any maintenance work that needs to be carried out on the property.

INTELLECTUAL AND INDUSTRIAL PROPERTY
GalindoBeach is the owner of the intellectual and industrial property rights in relation to all the contents and elements included in this website, and therefore they are strictly protected by the corresponding laws. It is strictly forbidden to reproduce, copy, publicly communicate, distribute, transform or modify the elements of the website, or to infringe any other right that may be protected by intellectual or industrial property law, unless authorised by the owner of the corresponding rights or it is legally permitted.

MODIFICATIONS
GalindoBeach reserves the right to modify, at any time, the contents, the rates of the services and the configuration of the website, as well as its Legal Notice, Privacy Policy, and Terms and Conditions, in addition to the possibility of temporarily suspending its services on the Website. If any changes are made to any of the above, the date of "Last update" will be updated at the top of the same. You will also be notified of changes by email at least thirty (30) days prior to the change taking effect. If you do not agree to the amended Terms, you have the right to terminate the Agreement. We will inform you of your right to terminate the Agreement in the notification email. If you do not terminate your Agreement prior to the date on which the amendments become effective, your continued access to or use of the GalindoBeach platform will constitute acceptance of the amendments made.

APPLICABLE LAW AND JURISDICTION
The contractual relationship between GalindoBeach and the Owner shall be governed by the applicable Spanish legislation, and any dispute shall be submitted to the Courts and Tribunals of Estepona.
